Terms of Service

1. Agreement to Terms
This Services Agreement is entered into between Sky Shades Customs Window Tinting LLC ("Sky Shades Customs," "Service Provider," "we," "our," or "us") and the Customer. By scheduling an appointment, paying a deposit, or using our services, you ("Customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Services
Sky Shades Customs provides professional window tinting and paint protection film services for automotive, residential, and commercial applications. Our services include but are not limited to:
- Automotive window tinting
- Residential window tinting
- Commercial window tinting
- Paint protection film (PPF) installation
- Related automotive protection services
3. Deposit and Cancellation Policy
- Deposits: A deposit of 20% is required at the time of booking to secure your appointment. The deposit is non-refundable once the appointment is confirmed.
- Cancellation with Notice: If the Customer cancels with at least 48 hours notice, the deposit may be applied to a future service within 90 days.
- Late Cancellation: Cancellations with less than 48 hours notice will result in forfeiture of the deposit.
- No-Shows: Failure to arrive for a scheduled appointment without prior notice will result in forfeiture of the deposit with no credit issued.
- Rescheduling: Appointments may be rescheduled with at least 48 hours notice without penalty, subject to availability.
4. Pricing and Payment
- Pricing: All prices are subject to change without notice. Quoted prices are valid for 30 days from the date of quote.
- Payment: We accept cash, all major credit cards, and debit cards. Payment is due in full upon completion of services unless otherwise arranged.
- Promotional Codes: Promotional codes and discounts are subject to terms and conditions and may not be combined with other offers unless explicitly stated.
- Sales Tax: Applicable Maryland state and local sales taxes will be added to all services.
5. Customer Responsibilities
- Customer must remove all personal belongings from the vehicle. Service Provider is not responsible for lost, damaged, or stolen items.
- Customer authorizes Service Provider to operate and test drive the vehicle if necessary for service purposes.
- Customer agrees to follow all care and maintenance instructions provided by Service Provider.
- Vehicles must be clean and free of excessive dirt, debris, or contaminants.
- Vehicles must be in proper working condition with functional windows and glass.
- Any existing window tint, PPF, coatings, or other treatments must be disclosed prior to service.
6. Customer Representations and Warranties
Customer represents and warrants that they have provided a complete description of all services and conditions with respect to the Customer's vehicle, including but not limited to dyeing of fabrics, application of any protective coatings or other products on the interior or exterior of the vehicle, and all other services previously provided that could affect Service Provider's service or the work product.
7. Latent Conditions
The parties acknowledge that there may be conditions present related to the services that cannot be known at the time an estimate is given. Customer acknowledges that Service Provider is not responsible for any damages caused by or related to the presence of a latent or undisclosed condition of the Customer's vehicle. In the event any circumstances become known which at the time of the estimate were not known to Service Provider, Service Provider reserves the right to increase the fee for any additional work required to account for such latent or undisclosed defect.
8. Warranty
Service Warranty
Service Provider warrants that the Services will be performed by qualified personnel in a professional and workmanlike manner in accordance with generally accepted industry standards and practices. Service Provider does not warrant in any form the results or achievements of the Services provided or the resulting work product and deliverables.
Window Tinting Warranty
- Economy Tint: 3-year warranty against fading, peeling, and bubbling
- Premium Tint: 5-year warranty against fading, peeling, and bubbling
- Supreme Tint: Lifetime warranty against fading, peeling, and bubbling
- Ultimate Tint: Lifetime warranty against fading, peeling, and bubbling
Paint Protection Film Warranty
All PPF installations include a 10-year warranty against yellowing, cracking, peeling, and delamination under normal use conditions.
Warranty Exclusions
Warranties do not cover:
- Damage caused by accidents, abuse, or neglect
- Damage caused by improper cleaning or maintenance
- Damage from defective glass or factory window seals
- Normal wear and tear from daily use
- Removal or tampering with the film
- Damage from power washing or high-pressure cleaning
Limitation of Warranty
THE WARRANTY SET FORTH IN THIS SECTION IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES, WORK PRODUCT OR DELIVERABLES PROVIDED HEREUNDER, OR AS TO THE RESULTS WHICH MAY BE OBTAINED THEREFROM. SERVICE PROVIDER DISCLAIMS ANY AND ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR AGAINST INFRINGEMENT. CUSTOMER'S EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY IS REPERFORMANCE OF THE SERVICES, OR IF REPERFORMANCE IS NOT POSSIBLE OR CONFORMING, REFUND OF AMOUNTS PAID UNDER THIS AGREEMENT FOR SUCH NON-CONFORMING SERVICES.
9. Limitation of Liability
Sky Shades Customs shall not be liable for:
- Pre-existing conditions or defects in glass, paint, or vehicle surfaces
- Damage to defective or aftermarket glass
- Loss or damage to personal property left in vehicles
- Indirect, incidental, or consequential damages arising from our services
- Any damages exceeding the cost of services provided
IN NO EVENT SHALL SERVICE PROVIDER BE LIABLE UNDER THIS AGREEMENT TO THE CUSTOMER FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, STATUTORY, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE, LOSS OF TIME, INCONVENIENCE, LOST BUSINESS OPPORTUNITIES, DAMAGE TO GOOD WILL OR REPUTATION, AND COSTS OF COVER, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON BREACH OF CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN. SERVICE PROVIDER'S ENTIRE AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES OR THIS AGREEMENT SHALL NOT EXCEED THE FEES PAID OR PAYABLE BY THE CUSTOMER TO THE SERVICE PROVIDER UNDER THIS AGREEMENT. THIS SECTION SHALL SURVIVE THE TERMINATION OF THE AGREEMENT.
10. Time Limit for Claims
NO ACTION SHALL BE BROUGHT FOR ANY CLAIM RELATING TO OR ARISING OUT OF THIS AGREEMENT MORE THAN ONE (1) YEAR AFTER THE ACCRUAL OF SUCH CAUSE OF ACTION, EXCEPT FOR MONEY DUE ON AN OPEN ACCOUNT.
11. Force Majeure
Service Provider shall not be liable hereunder for any failure or delay in the performance of its obligations under this Agreement if such failure or delay is on account of causes beyond its reasonable control, including civil commotion, war, fires, floods, accidents, earthquakes, inclement weather, telecommunications line failures, electrical outages, network failures, governmental regulations or controls, casualty, strikes or labor disputes, terrorism, acts of God, pandemics, epidemics, local disease outbreaks, scarcity or rationing of gasoline or other fuel or vital products, inability to obtain materials or labor, in addition to any and all events, regardless of their dissimilarity to the foregoing, deemed to render performance of the Agreement impracticable or impossible under the law, in which event the Service Provider shall be excused from its obligations for the period of the delay and for a reasonable time thereafter.
12. Tint Laws and Regulations
Customers are responsible for understanding and complying with Maryland state tint laws and any applicable local regulations. Sky Shades Customs is not responsible for citations, fines, or penalties resulting from window tint that does not comply with applicable laws. We are happy to advise on legal tint limits upon request.
13. Care Instructions
Window Tint Care
- Do not roll down windows for at least 3-5 days after installation
- Small water bubbles may appear and will dissipate within 2-4 weeks
- Clean with ammonia-free glass cleaner and soft cloth only
- Avoid abrasive materials on tinted surfaces
PPF Care
- Wait 48 hours before washing your vehicle
- Hand washing is recommended
- Avoid high-pressure washing directly on film edges
- Use pH-neutral car wash products
14. Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Sky Shades Customs Window Tinting LLC and is protected by applicable copyright and trademark laws.
15. Governing Law and Venue
This Agreement will be governed by and interpreted in accordance with the laws of the State of Maryland, USA, without giving effect to the principles of conflicts of law of such state. The parties hereby agree that any action arising out of this Agreement will be brought solely in any state or federal court located in Charles County, Maryland. Both parties hereby submit to the exclusive jurisdiction and venue of any such court.
16. Entire Agreement; Modification; Waiver
This Agreement, including any estimate or invoice attached hereto, is the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior agreement or communications between the parties, whether written, oral, electronic or otherwise. No change, modification, amendment, or addition of or to this Agreement or any part thereof shall be valid unless in writing and signed by authorized representatives of the parties. No waiver of any term or right in this Agreement shall be effective unless in writing, signed by an authorized representative of the waiving party.
17. Privacy
Customer information will be handled in accordance with Service Provider's Privacy Policy available at www.skyshadescustoms.com/privacy-policy.
18. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services after any changes constitutes acceptance of the new Terms.
